How to Submit a Freight Claim

All claims must be submitted in writing to claims@focus1logistics.com within nine (9) months from the date of delivery or the reasonable time delivery should have occurred, in accordance with the Carmack Amendment (49 U.S.C. § 14706).

To process your claim, you must provide:

  • A completed Freight Claim Form
  • Signed Proof of Delivery (POD)
  • Original Bill of Lading
  • Commercial or Supplier Invoice showing value
  • Photos of damage (if applicable)
  • Inspection report (if applicable)

Visible damage or shortages must be noted on the delivery receipt at time of delivery. Concealed damage must be reported promptly to allow inspection. Damaged goods and packaging must be retained for carrier inspection. Failure to preserve salvage may affect claim eligibility.

Freight charges must be paid prior to claim settlement. Liability is limited to the actual loss or damage to the goods at the time and place of shipment and is governed by the applicable Bill of Lading, FOCUS 1 Logistics, LLC Freight Claim Terms and Conditions, and federal law.

Consequential damages, lost profits, duties, taxes, and indirect damages are not recoverable. Submission of a claim does not guarantee payment.

INTENT TO CLAIM

Please provide a detailed statement showing how amount claimed has been determined (i.e. Number and description of articles, nature and extend of Loss/Damage, invoice price per unit, etc.)

    Provide a detailed written statement explaining:

    • Nature and extent of loss or damage
    • How the total claim amount was calculated
    • Invoice value per unit (USD) and quantity affected
    • Supporting cost documentation (invoices, repair estimates, replacement quotes)
    • Whether goods are repairable, salvageable, or destroyed
    • If salvage applies, location and condition of goods
    • If destroyed, include destruction documentation and date

These Freight Claim Terms and Conditions (“Terms”) govern all claims for loss, damage, shortage, or delay to shipments arranged or transported by FOCUS 1 Logistics, LLC (“Carrier”).

Submission of a freight claim constitutes acceptance of these Terms.

1. Governing Law

All freight claims are governed exclusively by the Carmack Amendment (49 U.S.C. § 14706) and applicable federal regulations, including 49 CFR Part 370.

2. Filing Deadlines

  • Claims must be filed within nine (9) months.
  • Lawsuits must be filed within two (2) years and one (1) day after denial.

3. Mandatory Written Claim Requirements

  • Shipment identification
  • Assertion of liability
  • Specific dollar amount claimed

4. Proof of Delivery and Inspection

Proof of Delivery signed without exception is strong evidence of proper delivery.

5. Concealed Damage

Must be reported promptly after discovery.

6. Required Documentation

  • Bill of Lading
  • Proof of Delivery
  • Invoice showing value
  • Proof freight charges paid
  • Photos if applicable
  • Inspection report if applicable

7. Freight Charges

Freight charges must be paid in full before claim processing.

8. Inspection, Mitigation, and Salvage

Damaged freight must be preserved for inspection.

9. Limitation of Liability

  • No consequential damages
  • No lost profits
  • No delay damages
  • No shipper fault liability

10. Claim Processing Timeline

  • Acknowledgment within 30 days
  • Resolution within 120 days
